For the TAB’s Jim Morrison …
The subcommittee voted unanimously [with one abstention] against lifting the deed restriction on 135 Wells Avenue that would be required to put a residential development in that office park. Then, it voted 3-0, with 3 abstentions in favor of rezoning and granting the special permit for the 80-unit, The Residences at Kessler Woods in Chestnut Hill, which will border both Brookline and West Roxbury.
Just wondering who the developers were for each of these projects?
Cabot Cabot & Forbes is the owner/prospective developer of 135 Wells Ave.
Sean — did they buy the land from Newton. how did they get a deed restriction?
@Hoss: the land was purchased from whomever owned the property where Boston Sports Club is (they would be moving).
The deed restriction exists on the entire Wells Ave Park and has been in place for approximately 50 years, with approximately 50 to go.
Chestnut Hill Realty is the developer in Chestnut Hill. They did the Hancock Village Apartments located in Chestnut Hill, Brookline & West Roxbury. They have been challenged by Newton, Brookline and West Roxbury for many years over this development and a Handcock Village expansion in court and in the State Legislature. It started out with 62 condo units and is now 80.
Does anyone know what the deed restriction actually says?
There’s a lot of backstory for anyone who’s interested here http://www.newtonma.gov/civicax/filebank/documents/62382
